Welcome to Bento Delivery! These Terms and Conditions ("Terms") govern your use of the Bento Delivery mobile application and website (collectively, the "Service"). The Service is owned and operated by Bento Delivery Service, a Delivery Service company located at Thongsangnang, Chanthabuly, Vientiane ("Bento Delivery," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not use the Service.
"Service" refers to the Bento Delivery mobile application and website, which facilitate the ordering, payment, and delivery of goods from third-party vendors by independent delivery drivers.
"User" or "you" refers to any person who accesses or uses the Service to order goods.
"Vendor" refers to a third-party restaurant or store that lists its goods for sale on the Service.
"Driver" refers to an independent contractor who uses the Service to accept and fulfill delivery requests.
"Content" includes all text, images, graphics, information, and other materials available on the Service.
Bento Delivery is a technology platform that connects Users with Vendors and independent Drivers. We do not prepare, package, or sell the goods ourselves. We are solely a facilitator of the transaction and delivery. We are not responsible for the quality, safety, or legality of the goods or services provided by Vendors or Drivers.
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Ordering: All orders are subject to availability. By placing an order, you agree to pay the total amount, including the item price, taxes, delivery fees, and any applicable service charges.
Payment: Payments are processed securely through a third-party payment processor. Bento Delivery does not store your credit card information. You agree to pay for all orders placed through your account.
Pricing: Prices are determined by the Vendors and may be subject to change. Bento Delivery reserves the right to charge service fees and delivery fees, which will be clearly displayed before you confirm your order.
Delivery Time: Delivery times are estimates and may vary based on factors such as Vendor preparation time, Driver availability, traffic, and weather conditions.
Responsibility: Drivers are independent contractors. Bento Delivery is not responsible for the actions or inactions of any Driver. Any issues with delivery should be addressed with our customer support team.
Failed Delivery: If a delivery cannot be completed due to your failure to provide accurate information, be available to receive the delivery, or other reasons within your control, you may still be charged for the order and delivery fee.
User Cancellations: You may be able to cancel an order within a short window after placing it. After this window, the order may be in preparation by the Vendor, and a cancellation may not be possible. If you can cancel, a full refund may be issued. If the order is already being prepared, you may not be eligible for a refund.
Vendor/Driver Cancellations: Orders may be canceled by the Vendor or Driver due to unavailability, unforeseen circumstances, or other reasons. In such cases, a full refund will be issued to your original payment method.
Refunds: All refund requests will be handled on a case-by-case basis. We will investigate the issue and determine if a refund is appropriate.
You agree not to:
Use the Service for any unlawful purpose.
Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
Interfere with or disrupt the Service or servers.
Engage in any abusive, harassing, or threatening behavior towards Vendors, Drivers, or Bento Delivery employees.
All Content, trademarks, logos, and intellectual property rights related to the Service are the exclusive property of Bento Delivery or its licensors. You may not use, copy, reproduce, or distribute any part of the Service without our prior written consent.
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. Bento Delivery does not warrant that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Bento Delivery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability to you for all claims arising from your use of the Service will not exceed the amount you have paid to Bento Delivery in the past six months.
You agree to indemnify and hold harmless Bento Delivery, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any privacy or intellectual property right.
These Terms shall be governed by and construed in accordance with the laws of Lao PDR, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Vientiane.
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
